PORT ORDINANCE IN THE TOWN OF RAUMA Approved by the Port Authority on 18 December 2002 103 Ratified by the Town Council on 20 January 2003 10 Enforced on 24 January 2003 I CHAPTER GENERAL REGULATIONS II CHAPTER VESSEL NOTICES III CHAPTER ARRIVAL AND BERTHING OF VESSEL IN PORT IV CHAPTER UNLOADING, LOADING AND STORAGE OF GOODS V CHAPTER PREVENTION OF POLLUTION OF THE PORT AND THE ENVIRONMENT VI CHAPTER FIRE PREVENTION VII CHAPTER ROAD AND RAIL TRAFFIC VIII CHAPTER MISCELLANEOUS REGULATIONS IX CHAPTER ACTIONS IN ACCIDENTS AND VIOLATION OF REGULATIONS X CHAPTER ENFORCEMENT I CHAPTER GENERAL REGULATIONS 1 In addition to applicable laws and statutes, as well as provisions based on these, the regulations of this Port Ordinance shall be complied with within the port area of the Town of Rauma. 2 The port area covered by this Port Ordinance includes a water area, the border of which starts at point no. 1 as indicated in the enclosed map (WGS84). For point 1, j = 61 07.465' N and ? = 21 27.782' E. From here the border runs through point no. 2, j = 61 07.479' N and ? = 21 27.766' E to point no. 3 j = 61 07.451' N and ? = 21 27.209' E, and from there it follows the current shore line to point no. 4 j = 61 07.237' N and ? = 21 27.237' E, where it turns to point no. 5 j = 61 07.238' N and ? = 21 27.112' E. From point 5 the border follows the border of plot 3/421/IV to point no. 6 j = 61 07.018' N and ? = 21 27.436' E and from there along the external side of the dam to point no. 7 j = 61 06.885' N and ? = 21 27.372' E, and further along the shore line to point no. 8 j = 61 06.299' N and ? = 21 27.578' E. From there the border follows the current town border through point no. 9 j = 61 06.210' N and ? = 21 27.106' E to point no. 10 j = 61 07.105' N and ? = 21 22.976' E, where the border turns to point no. 11 j = 61 08.464' N and ? = 21 23.596' E and further to point no. 12j = 61 09.250' N and ? = 21 26.934' E. Here the border turns through point no. 13 j = 61 09.096' N and ? = 21 27.225' E and point no. 14 j = 61 08.751' N and ? = 21 27.432' E to point no. 15 j = 61 08.148' N and ? = 21 28.152' E. From here the border follows the shore line as indicated in the town plan for I and II Petajas to point no. 16 j = 61 08.032' N and ? = 21 26.536' E and further through point no. 17 j = 61 07.936' N and ? = 21 27.025' E and point no. 18 j = 61 07.960' N and ? = 21 27.259' E to point no. 19 j = 61 07.928' N and ? = 21 27.417' E. The borders of the land area within the port are defined by the decision of the Town Council. The borders of the port area are indicated in the map enclosed to the Port Ordinance. 3 Responsibility for the administration of the port rests with the Port Board, under supervision of the Town Board. The Port of Rauma is responsible for the implementation of the administration of the port, under supervision of the Port Board. The duties of the port authorities that enforce this Port Ordinance are defined in Town Ordinances. Port authorities in the Town of Rauma include the Port Board, the Port Director, the Port Engineer, the Harbour Master, the Crane Engineer and the Deputy Director. II CHAPTER VESSEL NOTICES 4 The master or the agent of a vessel expected to arrive in the port shall submit an advance written notice to the port authorities. The advance notice shall be submitted as soon as the information is available, and at the latest 7 days prior to the expected time of arrival. The notice shall indicate the name of the vessel, the amount and type of her cargo and the estimated time of arrival in the port, as well as any other information that will facilitate the receiving and berthing of the vessel. Any changes in the information shall be forwarded to the port authorities without delay. For any cargo materials considered hazardous due to an explosion risk, flammability or other such properties, which are included in the International Maritime Dangerous Goods (IMDG) Code of the Inter-Governmental Maritime Consultative Organization (IMO), a written specification shall be submitted to the port authorities before the vessel arrives in the port area, with the exception of liquid fuels carried as bulk cargo. The port authorities shall be notified of the schedules of passenger vessels, and any changes in these, in good time before scheduled traffic is commenced or changed schedules are taken in use. 5 The vessel s arrival/departure notice and the specification of dangerous goods shall be submitted as an approved electronic message through the portnet or by some other means approved by the Port or by the Finnish Maritime Administration. As concerns tugs, fishing trawlers and corresponding vessels used in domestic merchant shipping, operating in and from the port, a notice shall be submitted to the port authorities before commencement of the service. The port dues and required notices for such vessels are determined in this connection. 6 The notice obligation as specified above in 5 does not apply to vessels owned by the State of Finland or by a foreign state, unless the vessel is used in merchant shipping. Vessels used for recreational purposes are also exempted from the notice obligation. A notice as specified in 4 need not be given of these vessels, either. These vessels shall report to the port control before arriving in the port area for allocation of a berth. 7 If the vessel comes from a locality infected by a contagious disease dangerous to the public, or if during the voyage an illness has broken out that is suspected to have been caused by a contagious disease or for which the cause is not known, the port authorities shall be notified of this in good time and the vessel is not allowed to enter the port area until instructions have been received from the port authorities. (Law on Health Care, 81 ) If the vessel carries animals and during the voyage there have been cases of death or severe diseases among the animals, the port authorities shall be notified of this. The unloading of the animals must not be commenced until the Town Veterinary Surgeon or some other veterinary authority has provided instructions for the unloading. III CHAPTER ARRIVAL AND BERTHING OF VESSEL IN PORT 8 When sailing within the port water area, the vessel s speed shall be adapted to the circumstances, the location and the structure of the vessel in such a way that no damage, harm or danger is caused to anybody. Special care shall be exercised when sailing past ferry routes, marine construction sites, dredgers, floating docks, heavy-laden barges, timber floats and jetties for small craft. The speed of the vessel shall always be adapted to the prevailing conditions and required caution shall be exercised within the port area. 9 Pilotage is not compulsory when moving the vessel in the port area, unless specifically ordered by a port authority. The state pilots are, however, entitled to pilot vessels in the port area if requested by the vessel s master. 10 The vessel shall be moored or anchored to the location indicated by the port authorities and shall not be relocated without the consent of the port authorities. The allocation of berths is carried out on the principle that the vessels are berthed in their order of arrival in the port area. An exception to this principle is possible by a decision of the Port Committee or by a special agreement so that certain vessels, lines or services are granted a priority to berths reserved for them. When moving the vessel in the port area, the master or the agent of the vessel shall submit an advance notice of the move to the local Vessel Traffic Service (VTS) Centre, and the master of the vessel shall submit a traffic notice to the VTS Centre prior to the move. The vessel s master shall keep himself informed of the depth of water at the berth. 11 When mooring and casting off the vessel, and during the vessel s stay at the berth, caution is to be exercised to avoid damage to the quay and to the cranes on the quay. If necessary, tug assistance shall be employed when mooring and casting off the vessel. The use of anchors should be avoided at berth. When berthed, the vessel shall be provided with sufficient fenders on the sides. Ramps and gangways shall be fitted with rails and protective nets and shall be illuminated in the dark hours of the day. Davits, derricks, cranes, gangways and other gear extending over the vessel s sides shall be placed in such a way that they will not obstruct the moving of the cranes on the quay or vessel traffic on the seaside of the vessel. The vessel s sewage outlets and corresponding openings shall be covered before entering the berth and during the vessel s stay at the berth so that no water or sewage is discharged onto the quay. The removal of snow and ice from the vessel onto the quay is forbidden. When berthed, the vessel s propeller may only be run at idle trial speed when preparing for departure, unless otherwise agreed on with the port authorities. 12 The vessel shall be relocated, if ordered by the port authorities. Within the port area, all vessels that have not been laid up shall be kept adequately manned to enable relocating of the vessel, if required. 13 Tankers carrying hazardous materials, and also other vessels if ordered by the port authorities, shall after mooring lay out two towing lines for emergency towing; one fore and one aft, to the vessel s seaward sides with the eyelets close to the surface of water. 14 Laying up of vessels in the port area is only permitted with the port authorities consent. The vessel shall be moored to a location specified by the port authorities and in a manner approved by them. The owner of the vessel shall ensure that the moorings are in working order at all times. The owner or the agent of the laid-up vessel shall entrust the maintenance of the vessel to a trustworthy person whose name and address is notified to the port authorities. IV CHAPTER UNLOADING, LOADING AND STORAGE OF GOODS 15 When unloading and loading goods, it shall be ensured that no damage is caused to the quay structures or to the port equipment used for loading or unloading. For heavy cranes used on the quay, the owner of the crane shall check the load-bearing capacity of the quay with the port authorities and ask for their approval for the crane s position. 16 In connection with loading and unloading operations, no goods, trailers or containers shall be placed in the way of the quay cranes, on the quay, on a street, on an alleyway, in front of warehouse doors, on fire hydrants, in front of life-saving equipment, or in any such position where they may hinder traffic or the mooring and casting off of vessels, excluding exceptional situations for which a permission shall be obtained from the port authorities separately for each case. No goods or units may be stored on a quay area used for loading and unloading without the consent of the port authorities. 17 Stevedoring equipment and machinery in private ownership, used in the port area, shall be furnished with the owner s name or identification; working machinery also with an identification number. The stevedoring equipment and machinery shall be removed from the quay area when work has been completed. 18 For unloading and loading of hazardous materials it is required that unless they are carried as bulk, they are furnished with appropriate identification, such as specified in the ADR, RID or IMDG code, and packed as specified in the code, and an advance written notice has been submitted to the port authorities. Where hazardous materials lack the specified identification and packing, the port authorities may forbid their unloading from the vessel or their transport by land to the port area for loading. The port authorities may also take any safety actions they consider necessary. 19 When unloading and loading bulk cargoes of hazardous materials, the vessel s master, or the consignor or the consignee of the goods shall at their own cost arrange sufficiently efficient security and safety measures, if ordered by the port authorities. Access of unauthorized persons to the unloading and loading area shall be prohibited by means of signs and stopped with appropriate rod barriers. To unloading and loading of liquid fuels in the oil harbour, separately issued regulations shall also apply. 20 Where vermin are found in the vessel s cargo, unloading shall be discontinued immediately. The master or the agent of the vessel shall inform municipal health care authorities and port authorities of the matter immediately, so that any required action can be taken. 21 When storing goods in the port area, the instructions issued by the port authorities shall be complied with. Goods must not be stored in such a way that they obstruct traffic or the use of life saving or fire fighting equipment. Any goods that due to a leak, odour or some other reason cause inconvenience or damage, shall be immediately removed from the port area. 22 No explosives or radioactive materials may be stored in the port area, unless this is permitted by a law or a statute, and a permission has been granted on the basis of such a law or statute. V CHAPTER PREVENTION OF POLLUTION OF THE PORT AND THE ENVIRONMENT 23 As concerns pollution of water, land areas and air in the port as well as silting up of the port water areas, the separate regulations as stipulated in Finnish legislation shall be complied with. 24 The vessel s master is responsible for ensuring that no oil or other effluents or waste is leaking, dumped or pumped from the vessel into the water or on land areas in the port. Discharges of steam, soot etc. that might cause danger or harm to the environment, to other port users or the port equipment are also prohibited. The master of the vessel shall see to it that all waste generated in the vessel is sorted in compliance with the instructions of the port and delivered to the waste containers provided in the port, and that all hazardous waste is delivered to a receiver approved to receive such waste under a licence based on the Law on Environmental Protection or a corresponding decision. 25 The vessel s master, or the consignor or the consignee of the goods shall immediately inform the port authorities of any goods fallen over board, or of any leakages of oil or other polluting substances into water or elsewhere in the port area, and shall take action to eliminate the same. 26 When handling goods in the port area, the operators shall see to it that the port area and the surrounding areas are not unnecessarily soiled. If the handling of goods generates dust that will soil other goods or hamper other activities, the handling process shall be discontinued until it can be resumed without causing any harm. The client who has ordered the work shall see to it that all garbage and waste is delivered for further processing and the handling sites are cleaned up. VI CHAPTER FIRE PREVENTION 27 Onboard ships carrying flammable goods, no open fire, repair work producing sparks or smoking is permitted on the vessel s open decks or on the quay and in the water areas near the vessel. Tankers shall be earthed immediately after mooring, using an earthing cable. The cable must not be disconnected until at the vessel s departure time. Ventilation of tanks in which flammable substances have been carried, is prohibited without the permission of the port authorities. The prohibition of open fire and smoking in the port and storage areas of oil and other flammable liquids extends also to water areas within a radius of 50 m from the quays and the vessels. The port authorities may also issue other safety instructions for such areas. 28 The marked fire fighting routes in warehouses and storage fields in the port area, as well as routes leading to fire hydrants, fire wells and extinguishing pipelines shall at all times be kept clear for passage. The fire fighting and life-saving equipment as well as the automatic fire alarm and life-saving devices shall at all times be kept in a working condition and the portable fire extinguishers readily available. 29 The crews of all vessels staying in the port have a statutory obligation to take part in fire fighting operations on vessels or in the port area, as well as in moving vessels away from dangerous locations, in accordance with the instructions issued by the authorities. VII CHAPTER ROAD AND RAIL TRAFFIC 30 Locomotives and trains of wagons moving in the port area, gantry cranes travelling on their own rails as well as wheeled and tracked port cranes have right of way over other vehicles. Parking is prohibited on crane and railway tracks. 31 The maximum permitted speed in the various parts of the port area is indicated by means of traffic signs. When alighting from a vehicle in the work or quay area, protective clothing that meets the requirements of at least EN 471: CE I shall be worn. 32 Parking within the port area shall take place as indicated by traffic signs. 33 The use of motor vehicles on ice within the port area is only permitted with the permission of the port authorities, unless a specific road or area has been expressly provided for this purpose. VIII CHAPTER MISCELLANEOUS REGULATIONS 34 Craft used for recreational purposes shall avoid unnecessary sailing within the port area and always give way to merchant vessels. Such craft must not be anchored in the port area or moored to quays reserved for unloading and loading of vessels, or to navigation marks or anywhere else where they might obstruct traffic. 35 No construction work, mounting of bridges, coffers or buoys, driving of piles or other obstacles is permitted in the port area where they might obstruct traffic, without the consent of the authorities. Fishing from quays, bridges or other corresponding structures is prohibited without the permission of the authorities. Swimming is not permitted in the inner harbour or in fairways. No leads may be opened in the ice without the permission of the port authorities. 36 The fire fighting, life-saving and first aid equipment provided in the port area may only be used for their proper purposes. 37 Access to parts of the port area which have been indicated as closed areas by means of fencing, traffic signs or prohibitory signs is forbidden without the consent of the port authorities. Customs, police and frontier guard authorities have the right to remove and the port authorities have the right to have removed any unauthorized persons or vehicles from the port area. Filming and photographing in the port area is only permitted with the permission of the port authorities. IX CHAPTER ACTIONS IN ACCIDENTS AND VIOLATION OF REGULATIONS 38 Where goods have landed in the water, or a vessel or a boat has run aground, flooded or sunk in the port area, the master of the vessel or the owner shall remove the vessel or the goods as soon as possible. Where a wreck or goods fallen over board cause danger to or obstruct traffic, the maritime authorities shall provide warning signs on the spot at the owner's cost, unless the owner of the vessel or the goods has done so. The maritime authorities also have the right to take immediate action to remove the wreck or the goods at the owner's cost. 39 In the event of a vessel causing damage to the quay or other port structures, the port authorities shall without delay call up a survey of the damages, with the person who has caused the damage or his superior, or his agent also present. 40 Prevention of oil spillage in the port area is governed by separate Finnish statutory regulations. (Act on the Prevention of Pollution from Ships 300/79) 41 If a vessel or a boat used for recreational purposes is moored against the port authorities regulations or obstructs traffic in the water areas of the port, and the master of the vessel or the owner of the boat fails to obey the orders, the port authorities have the right to have the vessel or the boat moved at the owner's cost, with the assistance of the Chief Executory Officer, if required. 42 If goods, working machines or vehicles are left against the port authorities regulations in the port area and the owner or the operator of the same fails to obey the orders to move or remove them, the port authorities have the right to move and store the goods, the machines or the vehicles at the owner's cost, with the assistance of the Chief Executory Officer, if required. 43 Vessels, boats and goods recovered by the port authorities, whose owner is unknown or for whom no owner is found within six months, shall be dealt with in compliance with the statutes on lost property. 44 Violations against this Port Ordinance and any regulations issued by the port authorities on the basis of this Ordinance are punishable by a pecuniary penalty, unless they are minor breaches or a special penalty is specified for them in legislation. In addition, the offender is legally liable to reparation of damages and costs. X CHAPTER ENFORCEMENT 45 This Port Ordinance of the Town of Rauma, which replaces the Port Ordinance of the Town of Rauma as, ratified on 15 March 1979, and its subsequent modifications and amendments, shall be enforced on 24 March 2003. In 2003, 5.95 million tons of cargo was handled in the port of Rauma , an increase of 4.6% compared to 2002. Port of Rauma (Finland) - Rauman Satama
