The country is well positioned to serve the countries in the Mediterranean. Logistics Of The Port The Port of Valletta is made up of over 3.5 kilometres of quays with a maximum draft of 12 metres. A safe port throughout the whole year. Port operations are carried out on a 24 hour, 7 days a week basis. Well equipped tugs and highly qualified pilots. The three main activities that have been set up, namely container handling, oil products handling and storage and industrial warehousing, have amply proved their worth. The rapidly increasing demand for container transhipment led to the construction of a second container terminal, which is expected to be fully operational by the end of 1998. Registration of vessels under the Malta flag and operation of Maltese ships is regulated by the Merchant Shipping Act, which has been heavily amended in the last few years in order to make the Maltese Registry more attractive. Registration Quick and effective registration is available through the procedure for provisional registration which last for six months, during which all documentation must be finalised. The advantages available to Maltese registered vessels include the following: Low company taxation and ship registration costs. Complete tax exemption to owners, charterers and financiers of Maltese ships of over 1000 net tons. This exemption may also be extended to smaller ships. No restrictions on the nationality of the master, officers and crew provided they are certified according to Maltese law and they are eligible under the STCW Convention. The definition of ships is wide, incorporating oil rigs and other types of vessels. No restrictions on the sale or transfer of shares of a company owning Maltese Ships. No trading restrictions. Malta is party to several international conventions relating to shipping. Malta has concluded several tax treaties. Bareboat Charter Registration Maltese law also provides both for bareboat charter registration of foreign ships under the Malta flag and for the bareboat charter registration of Maltese ships under a foreign flag. Vessels so registered enjoy the same rights and privileges, and have the same obligations, as any other ship registered in Malta. The two main principles adopted at law on bareboat charter registration are the compatibility of the two registries, and, that matters regarding title are governed by the underlying registry, while the operation of the vessel falls under the jurisdiction of the bareboat charter registry. Fiscal Advantages Malta offers a complete tax exemption in respect of all profits and dividends arising from shipping operations. The tax advantages available to Maltese shipping companies include the following: No income tax is payable by a Maltese shipping company; No inheritance tax is payable on the transmission on death of shares in a Maltese shipping company; No capital gains tax is payable on the sale or transfer of a ship or shares in a shipping company. No document duty is payable in respect of instruments connected with or involving the registration of a ship, the allotment or transfer of shares in a shipping company, the transfer of a ship or charges over a ship.
